A - GENERAL TERMS AND CONDITIONS OF SALE
1. Purpose
These general terms and conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by our establishment, whose contact details are specified in this reservation confirmation document. They govern all steps necessary for the reservation and follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale for the reserved rate, accessible on our reservation platform. These general terms and conditions of sale apply to all reservations made online, via our reservation platform.
2. Reservation
The customer chooses the services presented on our reservation platform. The customer acknowledges having read the nature, destination, and booking terms of the services available on our booking platform and having requested and obtained the necessary and/or additional information to make their booking with full knowledge of the facts. The customer is solely responsible for their choice of services and their suitability for their needs, and we cannot be held liable in this regard. The reservation is deemed accepted by the customer at the end of the booking process.
3. Booking Process
Bookings made by the customer are made using the electronic booking form available online on our booking platform. The reservation is deemed to be made upon receipt of the booking form. The customer undertakes, prior to any booking, to complete the information requested on the booking form or booking request. The customer attests to the truthfulness and accuracy of the information provided. After the final selection of the services to be booked, the reservation process includes entering the credit card details in the event of a guarantee or prepayment request, reviewing and accepting the general terms and conditions of sale and the terms and conditions of sale for the reserved rate before confirming the reservation, and finally, confirming the reservation by the customer.
4. Reservation Acknowledgment
Our reservation platform acknowledges receipt of the customer's reservation by promptly sending an email. For online reservations, the email acknowledgment summarizes the contract offer, the reserved services, the prices, the terms and conditions of sale for the selected rate, accepted by the customer, the reservation date, information regarding after-sales service, and the address of the seller's establishment where the customer can submit complaints.
5. Cancellation or Modification by the Customer
The traveler may cancel reservations free of charge within 24 hours of booking. The guest may cancel their standard rate reservation free of charge up to 6 days prior to arrival. The special terms and conditions of sale for the reserved rate specify below the cancellation and/or modification procedures for the reservation, depending on the rates, weekly rates, special offers, and promotions. When permitted by the terms and conditions of sale for the reserved rate, cancellations may be made directly with the property and the hosts, whose contact details are provided on the reservation confirmation sent by email. All reservations are personal and may not be transferred to a third party, whether free of charge or for a fee.
6. Use of the Service
In accordance with regulations in force in certain countries, the guest may be asked to complete a police form upon arrival. To do so, the guest will be asked to provide proof of identity to verify whether or not they are required to complete the police form. Any behavior contrary to morality and public order will result in the establishment asking the customer to leave without any compensation and/or without any refund if payment has already been made. For establishments with Internal Regulations, the customer accepts and agrees to comply with these regulations. In the event of non-compliance by the customer with any of the provisions of the Internal Regulations, the establishment will be obliged to ask the customer to leave without any compensation and/or without any refund if payment has already been made.
7. Liability
The photographs presented on our booking platform are not contractually binding. Although every effort is made to ensure that the photographs, graphic representations, and texts reproduced to illustrate the establishments presented provide as accurate a picture as possible of the services offered, variations may occur between the time of booking and the day of service delivery. The establishment cannot be held liable for non-fulfillment or improper fulfillment of the reservation in the event of force majeure, due to a third party, or due to the customer, including internet unavailability, inability to access the website, external intrusion, computer viruses, or in the event of unauthorized prepayment by the cardholder's bank. Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent for reasons attributable to the customer will result in cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the customer.
8. Complaints
Complaints regarding the non-performance or poor performance of the booked services must, under penalty of foreclosure, be brought to our attention in writing within eight days of the establishment's departure date.
9. Prices
The prices relating to the reservation of services are indicated before and at the time of booking. Prices are confirmed to the customer in the amount inclusive of tax, in the establishment's trading currency, and are only valid for the duration indicated on the booking platform. If the debit at the establishment is made in a currency other than that confirmed on the booking, the exchange fees are the customer's responsibility. All reservations, regardless of their origin, are payable in the establishment's local currency, unless otherwise indicated on site. Unless otherwise stated on the booking platform, additional services are not included in the price.
Taxes (local taxes, tourist taxes, etc.) are mentioned and included in the booking amount. If they are not listed, they are presented on the rates page and must be paid directly to the establishment. Prices include the VAT applicable on the day of the order, where applicable, and any changes to the applicable VAT rate will be automatically reflected in the prices indicated on the invoice date. Any changes or introduction of new legal or regulatory taxes imposed by the relevant authorities will be automatically reflected in the prices indicated on the invoice date. However, this rental is not subject to VAT.
10. Payment
The guest provides their bank details as a reservation guarantee, except under special conditions or rates, by credit or private debit card (Visa, Mastercard, American Express, Diners Club, etc., depending on the options offered by the establishment's reservation platform). They must provide their card number directly in the designated area (secure entry via SSL encryption), without spaces between the numbers, as well as its expiration date (it is specified that the bank card used must be valid at the time of use of the service) and the security code. Payment is debited at the establishment during the stay, except in the case of special conditions or rates where partial or full payment is debited at the time of booking. This prepayment is considered a deposit.
In the event of cancellation of the reservation under the conditions and within the timeframe permitted in the special rate conditions (standard, weekly), the reservation amount will be fully refunded to the guest. In the event of cancellation of the reservation outside the time limits authorized in the special price conditions, or in the event of a no-show (reservation not canceled - customer not present) of a reservation guaranteed by credit card, the establishment will debit the customer, as a fixed compensation, the amount indicated in its general conditions and special conditions of sale.
The establishment has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the guest's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, limit reached, data entry error, etc. In the event of a problem, the guest must contact their bank and the establishment to confirm their reservation and payment method. For rates subject to online prepayment, the amount paid in advance, which is the deposit, is debited at the time of booking. Invoices/bills can be generated electronically upon request; the original file is certified and available online at the website address provided by the establishment.
11. Respect for Privacy
The guest is informed, on each of the personal data collection forms, whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, its service providers (and in particular online payment providers). The customer authorizes elloha.com to communicate their personal data to third parties on the condition that such communication is compatible with the performance of the operations incumbent on elloha.com under these general conditions and in connection with the Customer Charter for the protection of personal data. In particular, when paying online, the customer's bank details must be transmitted by the payment provider stripe.com to the establishment's bank, for the execution of the reservation contract. The customer is informed that this transfer of data may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of the Data Protection Act. However, the customer consents to this transfer, which is necessary for the execution of their reservation. Constellation SAS / Stripe.com, in their professional capacity, have undertaken to the establishment to take all security measures and respect data confidentiality for said data transfers.
12. Proof Agreement
The entry of the required banking information, as well as the acceptance of these general terms and conditions and the reservation form or request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized records stored in the elloha.com computer systems will be kept under reasonable security conditions and considered as proof of communications, orders, and payments between the parties. The customer is informed that their IP address is recorded at the time of booking.
13. Force Majeure
Force majeure is understood to mean any event external to the parties that is both unforeseeable and insurmountable and prevents either the customer or the establishment from fulfilling all or part of the obligations set out in the contract. Force majeure or unforeseeable circumstances are those generally recognized by the case law of French courts and tribunals. Neither party shall be held liable to the other party for failure to perform its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the performance of the parties' mutual obligations and that each party shall bear the costs arising therefrom.
14. Dispute Resolution
These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may apply in the consumer's country of residence.
15. Entire Agreement
These General Terms and Conditions of Sale, the terms and conditions of sale for the rate reserved by the customer, and the reservation voucher or request express the entirety of the parties' obligations. No general or specific terms and conditions communicated by the customer may be incorporated into these general terms and conditions. The documents constituting the contractual commitments between the parties are, in descending order of priority, the reservation voucher or request (including the specific terms and conditions of the reserved rate) and these general terms and conditions. In the event of a contradiction between the reservation voucher and the general terms and conditions, the provisions contained in the reservation voucher shall be the only ones applicable to the obligation in question. These general terms and conditions of online sale may be modified and/or supplemented at any time by the establishment. In this case, the new version of the general terms and conditions of online sale will be posted online by the establishment. As soon as it is posted online, the new version of the general terms and conditions of online sale will automatically apply to all customers.

B - SPECIAL RATE SALES CONDITIONS
I. CANCELLATION POLICY
FLEXIBLE STANDARD RATE
Guests may cancel their standard rate reservation free of charge up to 6 days prior to arrival. Payment methods (credit card, checks, etc.) will not be charged or collected, except for payments via ANCV (French holiday vouchers), which are non-refundable. In the event of an agreed prepayment, the prepaid amount will be refunded within 1 hour and 1 week following cancellation via a payment method to be agreed upon between the guest and the hosts (e.g., bank transfer, PayPal, cash in euros).
The full amount of the reservation will be retained if the guest cancels within 5 days prior to arrival.

NON-REFUNDABLE OFFERS
Special offers are non-refundable, unless otherwise stated. The full amount of the reservation is retained if the traveler cancels at any time.
Promotions are generally non-refundable.
CHANGE OF DATES AND WITHDRAWAL
Guests are authorized to change their dates themselves.
Only once, at least 5 days before arrival.
If the rate is the same or higher than the original reservation.
If the booking conditions and accommodation type remain the same.
II. CONDITIONS OF USE
ARRIVAL AND DEPARTURE:
Arrival/Check-in: from 3:00 p.m. at any time, with complete autonomy thanks to a code. However, your hosts would also be delighted to welcome you personally.
The access code to the apartment and the access code to the Victoria Surf Residence (main entrance and beach-side entrance to the pool) are sent to guests within 24 hours of their arrival.
A Welcome Booklet in several languages is available in the apartment. It provides information on Wi-Fi access, the apartment's amenities and appliances, ideas for dining and shopping, and nearby activities and places of interest.
Departure/Check-out: 11:00 a.m. The access code becomes inactive at 11:00 a.m. on the day of departure.
HOUSE RULES AND OTHER CONDITIONS
This accommodation is non-smoking. However, smoking is permitted on the balcony with the French doors closed.
Pets are welcome (contact us).
Parties/events are not permitted.
Guests must avoid making noise between 10:00 p.m. and 8:00 a.m.
HOUSEHOLD
Cleaning is done before arrival and upon departure.
For stays < 15 days: The cleaning fee upon departure is included in the reservation amount. For stays of 2 weeks, bathroom and kitchen towels are changed on the 7th day at no extra charge, but not the bedding. A change of bedding (sheets, duvet cover, pillowcases) and towels can be provided upon request. This service is charged at €25 for two people, €40 for three people (including dry cleaning).
For stays ≥ 15 days: a full cleaning service, including cleaning and sanitizing surfaces, changing bedding and towels, and returning the studio to its original condition, can be provided upon request. It is charged at €65 for 1 or 2 people + €20 for 3 people.
Supplements or overpayments are adjusted and paid upon arrival and/or departure, as appropriate.
OPTIONAL SERVICES
Transfers to Biarritz Airport or Train Station (contact us). A transfer is free for all bookings for stays longer than 7 days.
Baby equipment, including a travel cot/folding crib, a high chair, and a baby bath are available free of charge upon request. Bedding (pillow, duvet, sheets, dry-cleaned) is provided upon request at an additional cost (contact us).
Other services are available subject to availability: parking, luggage storage, croissants, etc.
GUARANTEES:
A detailed inventory with figures is available in the Welcome Booklet in the apartment. It constitutes reference to and acceptance of the conditions below.
Any damage affecting an expensive item in the apartment will be invoiced at the purchase price of the items listed in the inventory, plus 10% to account for replacement costs and price increases.
In the absence of an amicable agreement on reimbursement, an assessment and calculation will be carried out by an insurance expert and/or a bailiff at the occupant's expense. The property management reserves the right to take legal action.
WHAT IF THINGS DO NOT GO AS PLANNED?
Someone will be waiting for you on site or will be there very quickly. The hosts live in Biarritz and are less than 15 minutes away.
The hosts' telephone numbers are provided on the receipt sent upon booking and in all correspondence.
In case of emergency, other contact details, including that of the Residence Victoria Surf Caretaker, are listed in the Welcome Booklet available in the apartment.
